Presentation

Jeremy is a leading lawyer in the fields of trademarks, designs, and copyright. His practice is broad, and his clients include well-known names across a wide range of sectors, from luxury goods and pharmaceuticals to consumer products and professional services.

Jeremy has been involved in some of the landmark cases that have shaped intellectual property law, such as:

  • -L'Oréal v. eBay, which concerned the liability of online e-commerce platforms, and was the first case to consider injunctions against non-infringing intermediaries.
  • -Cadbury v. Nestlé, which dealt with the registrability of the shape of a four-fingered KitKat bar.
  • -Glaxo v. Sandoz concerning the color and shape of an asthma inhaler for infringement.
  • -Swatch v. Samsung (Court of Appeal), where Jeremy acted as co-counsel to assist with the appeal concerning the scope of the e-commerce defense for a platform.

Although many of his clients are plaintiffs, Jeremy is part of the team that has made Bristows one of the leading trademark defense firms in the UK, defending Vectura, Fidelis, Verweij Fashion, YouView, and BDO Unibank in trials before the High Court. More recently, Jeremy has acted for:

  • -Glebe Farm in a widely publicized trademark and passing-off lawsuit filed by Oatly AB.
  • -Muzmatch in a widely publicized trademark and passing-off lawsuit filed by Match.com.
  • -Heineken in a claim regarding a non-alcoholic beer.

Jeremy has vast experience in seeking or defending interim relief applications and has successfully obtained interim injunctions, freezing orders, and Norwich Pharmacal orders (compelling a third party to disclose details of an alleged infringer) for clients in the luxury goods sector.

Jeremy also has extensive experience in registered and unregistered design disputes and copyright litigation for a diverse range of products, including jewelry and luxury fashion, plastic containers, artwork, pharmaceuticals, and consumer goods.

In matters involving platform liability, Jeremy specializes in strategies for combatting intellectual property infringements in the digital world, as well as advising on the potential liability of technology platforms.

As part of his practice in the breach of confidential information, Jeremy has significant experience in arbitration, particularly before the LCIA, SCC, and ICC. Jeremy specializes in technical arbitration, with cases ranging from chemical compounds used in deodorants to chemical processes. Many of his arbitration cases involve substantial claims for damages.

Jeremy is the former chair of the MARQUES Litigation Committee and is a member of various committees of INTA.
