Immigration and Foreign Law Human Rights Asylum Claims

Office business card:

Presentation

The fact that I was born Austrian and can live here with all my rights and freedoms is not my achievement. It is both a coincidence and a privilege. I am very aware of this privilege and am happy to stand up for those who are less privileged.

My belief in human rights led me to study law. Since 2003, I have been working in the field of immigration and asylum law , where fundamental and human rights are particularly at risk.

My work as a lawyer gives me the opportunity to provide comprehensive support to people in difficult situations in these legal areas.

I am efficient and organized and don't get easily unsettled by anything.

My career

I studied law at the University of Vienna, where I also completed a specialization in fundamental and human rights and wrote my doctoral thesis in immigration law on the topic of family reunification .

My training was primarily in German and partly in English, but I also have basic knowledge of French and Spanish.

In 2010 I passed my bar exam with very good results.

I completed my practical training as a lawyer in Vienna at the “Rechtsanwaltsbüro Soyer Embacher” (now Rechtsanwaltsbüro Soyer Kier Stuefer ) and at the law firm Embacher Neugschwendtner Rechtsanwälte  .

In 2011, I was registered as a lawyer and worked as a partner at “Ecker Embacher Neugschwendtner Rechtsanwälte/-in” until the birth of my second son in September 2017.

In January 2019, after a short maternity leave, I started my own business in my office on the Opernring

My work

I advise, accompany and represent people who want to enter or immigrate to Austria, who are seeking protection from persecution, who want to work in Austria, who want to obtain Austrian citizenship or who want to bring their family to Austria. I offer support at all stages of the process.

In order to find the best possible solution for every problem and to continue learning, I like to work with colleagues and NGOs throughout Austria. I have been a member of the Asylum Lawyer network for many years .

I regularly write publications in my specialist areas, give lectures and teach in the legal advice course of Caritas and at the University of Vienna as part of the Refugee Law Clinic of the Vienna Law Clinics .

A portrait of some colleagues and me in the magazine Profil:

The Fighters in the Shadows

The small group of Austrian asylum lawyers is using all the means available to them under the rule of law to fight xenophobia and is desperately fighting for professional recognition. A losing battle, some fear.

specializations

After an honest assessment of your options and prospects of success, I will provide you with committed and competent support at a fair price.

right of settlement and residence

Austria has a restrictive and complicated immigration system. I would be happy to discuss your personal residence rights options with you and prepare your application. I will advise and represent you at all stages of the process as required.

foreign employment law

Access to the labor market for people without Austrian citizenship is regulated in a complex way. I support foreigners and companies in applying for the necessary residence and employment permits and also advise on starting self-employment.

asylum and immigration law

I have been specializing in asylum and immigration law since 2003, and have also worked as a lawyer within the Asylum Lawyers Network for many years. I advise and represent asylum seekers as needed, from the application stage to the final decision, and I also provide support in immigration police proceedings.

citizenship law

After a few years of living in Austria, the desire to acquire Austrian citizenship often arises. I offer you a good overview of your options and the requirements for naturalization.

fundamental and human rights

Human rights can be violated by administrative and judicial decisions, but also by the direct application of state command and coercive power. I advise you and represent your interests before Austrian authorities and courts as well as before the European Court of Human Rights.

administrative criminal law

Administrative penalties lurk in practically all areas of Austrian administrative law. I also advise and represent clients in administrative penal proceedings.

appeals and representation before the Administrative Court

To file an appeal in an administrative procedure, you need legal representation. I can look back on many years of successful representation before the Administrative Court and would be happy to support you!

Complaints and Representation before the Constitutional Court

You will also need legal representation for proceedings before the Constitutional Court. I have many years of experience here too and have won numerous appeals.
